So why fold down and not up? seems odd to fold it down the turn it on its head?

Up is the direction the props are pushing. That would be a horrible idea with the possibility of folding during flight.

It shouldn't fold mid-flight if it has been designed well, as it stands its poorly thought out and is not a competitor to the S800(Its competition is here, folding octocopter http://www.fpvmodel.com/foldable-octocopter-skyknight-fold-x81100-body_p392.html ), you will have to remove all your props to avoid breaking one before packing down, droidworx is developing arms that fold up which will aide in a fast pack down while leaving everything set up without having to disassemble
